1. Your Order
When you order an item or service via this website, you enter in to a contract with Spirit Holiday Rentals Ltd. as providers of the service. Spirit Holiday Rentals Ltd. is responsible for the administration of your order and the provision of the service(s) ordered.
Spirit Holiday Rentals Ltd. reserve the right to reject your order before taking payment from your credit/debit card. In this case, you will be notified via the email address you supplied when placing the order.
2. Paying for your Order
Payment is only accepted by credit or debit card via the third-party Google Checkout service. Spirit Holiday Rentals Ltd. do not directly operate the Google Checkout service, and shall not be held financially responsible for any wilful misuse or negligent use of the Google Checkout service resulting in personal financial loss, or loss of personal data resulting in subsequent financial loss. Further, Spirit Holiday Rentals Ltd. shall not be held responsible for any adverse impact suffered by any customers due to any negligence on behalf of the Google Checkout service. Use of the Google Checkout service is entirely at your own risk.
Payment is only accepted prior to 4 weeks before the start date of your ordered services. Any order placed less than 4 weeks prior to the start date of your ordered services is accepted at the sole discretion of Spirit Holiday Rentals Ltd.
3. Cancelling or changing your Order
Spirit Holiday Rentals Ltd. do not expect to have to make any changes to your order. However, occasionally problems occur and orders may have to be changed or cancelled. In this case, Spirit Holiday Rentals Ltd. will contact you via the email address speicified by you during the order process. Spirit Holiday Rentals Ltd. will then refund, by cheque with 10 working days, the cost of any services which can no longer be provided. If the cancelled services only form part of your order, you may at this point cancel the entire order and receive a full refund by cheque within 10 working days.
If you wish to, or need to, change part or all of your order, or cancel your entire order, in the first instance please contact Spirit Holiday Rentals by email via sales@borovets-ski-packages.com.
If you wish to change your order, this can be done no later than 4 weeks prior to the start date of the services specified by you during the order process, subject to the conditions described herein. Additions to your order may be made free of charge. Subtractions from your order are liable to an administration fee of £25, and this will either be deducted from the refund amount of the cancelled services (which are paid to you by cheque within 10 working days). If the administration fee is greater than the purchase value of the cancelled services, no refund shall be payable.
If you wish to, or need to, cancel your order within 4 weeks of the start date of the services specified by you during the order process, the refund due is calculated according to the following table.

4. Force Majeure
Except where otherwise expressly stated in these Terms and Conditions, Spirit Holiday Rentals Ltd. shall not be liable jointly or individually, for any changes, cancellations, effect on your holiday, loss or damage suffered by you or for any failure by us to perform or properly perform any of our obligations to you due to any event(s) or circumstance(s) beyond our reasonable control (referred to as 'Force Majeure' in these Conditions).
By way of example, force majeure includes fire, flood, exceptional weather conditions, epidemics, (other than our negligence) and all similar situations affecting either the ski school providing the equipment and tuition, or the skiing conditions within the resort itself.
In appropriate cases (for example where your order has to be cancelled by us before your arrival) we will, however, refund to you all monies paid to us by you for your order. No compensation, expenses, costs or other sums of any description (including without limitation the cost of securing an alternative property/accommodation) will be payable by Spirit Holiday Rentals Ltd.
5. Website Details
Spirit Holiday Rentals Ltd. aims to ensure that the information provided is accurately conveyed in this website and other promotional literature or material produced and circulated by us. Whilst every effort is made to ensure the accuracy of the website/other material and prices at the time of publishing, errors may occasionally occur. You must therefore ensure you check all details of your order with us at the time of ordering.
Occasionally, problems, mean that some facilities or services become unavailable or subject to restriction. If this happens, we will tell the party leader as soon as reasonably practical. We cannot accept responsibility for any changes or closures to area amenities or attractions mentioned in the website, in the brochure or advertised elsewhere. We make reasonable efforts to ensure that information supplied to you in relation to the services offered is accurate and complete as at the date given. We cannot accept responsibility for any inaccurate, incomplete or misleading information about any service, except in the case of our negligence. We will, however, use our best endeavours to notify you of any changes to or inaccuracies in any information contained in the website or otherwise provided to you as soon as reasonably practical after we become aware of the change or inaccuracy.
6. Liability
Spirit Holiday Rentals Ltd. shall have no liability for any death or personal injury unless this results from our negligence or that of any of our employees (providing they were at the time acting in the course of their employment). You must take all necessary steps to safeguard you personal property. No liability is accepted by us in respect of damage to, or loss of, such personal property except where the damage or loss is caused by our negligence or that of any of our employees (providing they were at the time acting in the course of their employment).
7. Complaints
Every effort has been made to ensure that you have an enjoyable and memorable holiday. If however, you have any cause for complaint we are anxious that remedial action is taken as soon as possible. It is essential that you contact us or our representative immediately if any problem arises so that it can be speedily resolved.
If you have a complaint about our services whilst in the resort, you are responsible for notifying the manager of the Ski School (or a suitable representative) in order that the problem may be identified and resolved without further recourse. All appropriate contact details are provided in the voucher(s) issued following payment of the services provided (i.e. prior to your arrival in the resort). If you fail to notify a suitable Ski School representative whilst in the resort, Spirit Holiday Rentals Ltd. shall not be held responsible for the cause of any such complaint, nor be liable for any claim for compensation arising from the complaint.
8. Communicating with You
For the purposes of the Data Protection Act 1998, Spirit Holiday Rentals Ltd. are the sole data controller of all personal data provided by customers and prospective customers.
9. Law
The contract between us is subject to English law. It is agreed that any dispute you may have with us will be dealt with by the Courts of England and Wales unless you live in Scotland or Northern Ireland in which case proceedings may be brought in the Courts in those countries.
10. Your Rights
Your statutory rights are not affected by anything contained within these Terms and Conditions.
